These Terms are an agreement between you and Ivory Plains, the corporation that operates ivoryplains.com and the Ivory Plains service. By creating an account or purchasing, you accept them.

2. The service
A retirement plan delivered for a published fee. Send your statements and back comes a dated plan: when to claim, what to convert and in which years, which account to draw first, and the deadlines that decide the tax bill. Ivory Plains delivers written retirement planning analysis. It does not take custody of your assets, does not execute trades, does not hold accounts, and does not sell securities or insurance products.
3. Accounts
You give accurate information, you keep your credentials secure, and you are responsible for activity under your account. You must be 18 or older.
Notify us immediately if you suspect unauthorized access.
4. Purchases and billing
The fee for each service is published on the site before you buy. Ivory Plains charges the payment method you provide. A one time plan is charged once. An ongoing service is charged on the cycle shown at checkout until you cancel, and cancellation takes effect at the end of the paid period.
5. Scope of the engagement
The scope of the work, the fee, and whether the engagement constitutes investment advice requiring registration are governed by the written client agreement and the firm's current disclosure brochure, both provided before you pay.
No advisory relationship exists until the written client agreement is signed.
A one time plan is a document delivered on a date. It is not monitored, and nothing is reviewed again unless an ongoing service is purchased.
6. Not tax advice and not legal advice
The plan models tax outcomes under the rules in effect on the date printed on it. It is not a tax return, a tax opinion, a legal opinion or an estate planning instrument.
Confirm any figure with your own tax preparer or attorney before you act on it, and Ivory Plains does not prepare or file returns.
7. The rules change
Claiming ages, required distribution ages, contribution limits, bracket thresholds and premium surcharge tiers are set by statute and regulation and they change.
The plan is accurate as of its stated date. A change in the law after that date is not an error in the plan.
8. What you are responsible for
The plan is built from the statements, benefit estimates and figures you provide. If those are incomplete or out of date the plan will be too.
You decide whether to act on it, and you carry out every instruction with your own custodian, employer plan or insurer.
9. Acceptable use
You will not misuse the service, attempt to access other users data, resell access without permission, or use the service to break the law.

10. Intellectual property
The software, the interfaces, the written materials and the site belong to Ivory Plains or its licensors. You keep ownership of the content and data you supply.
11. SMS messaging, account notifications
Program description: Ivory Plains sends recurring automated account notifications text messages to the mobile number you provide. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply.

12. Disclaimer
The service is provided as is. To the fullest extent permitted by law, Ivory Plains disclaims all warranties, express or implied, including fitness for a particular purpose.
13. Limitation of liability
To the fullest extent permitted by law, Ivory Plains is not liable for indirect, incidental, special, consequential or punitive damages, and total liability is limited to the amount you paid in the twelve months before the claim. Ivory Plains may update these Terms. Material changes are posted on this page with a new date. These Terms are governed by the laws of [STATE], without regard to conflict of law rules.
